Ski Demo Rental Program User Agreement

This User Agreement is entered into between Icelantic Skis ("Icelantic LLC") and the undersigned individual ("Customer") for participation in the Icelantic HQ Demo Rental Program. By signing this Agreement, the Customer acknowledges and agrees to the following terms and conditions:

1. Assumption of Risk

The Customer understands and acknowledges that skiing and the use of ski equipment involve inherent risks, including but not limited to the risk of personal injury, property damage, or death. By participating in the Program, the Customer voluntarily assumes all risks associated with the use of the rental equipment and agrees that the Company, its agents, employees, and affiliates shall not be held liable for any injury, damage, or loss resulting from such use.

2. Rental Terms

  • Reservation and Pickup: The Customer agrees to reserve the skis online and pick them up at either the Company’s location or Denver Sports Lab at the scheduled time.
  • Rental Period: The Customer agrees to use the equipment only for the duration of the rental period specified in their reservation.
  • Return of Equipment: The Customer must return the equipment to the designated drop-off location by the agreed-upon date and time. Late returns are subject to additional charges as outlined below.

3. Damage and Loss

  • The Customer is responsible for the care and maintenance of the rental equipment during the rental period.
  • In the event of loss or theft of the equipment, the Customer agrees to pay repair or replacement costs as determined by the Company.
  • Normal wear and tear are excluded from damage charges, but the Customer may be charged for significant damage caused by misuse or neglect.
  • The customer is expected only to use the skis for the intended purpose of skiing in certified ski resorts (backcountry skis excepted).

4. Late Returns

If the Customer fails to return the equipment by the agreed-upon date and time, they may be charged a late fee of $50 per day. If the delay exceeds 1 day, the Customer may be charged up to $100 per day.

5. Payment and Credit for Future Purchase

The Customer agrees to pay the rental fee online at the time of reservation. The Customer understands that after their rental period they may apply their cost of rental, of up to $150, towards the purchase of a full-priced ski. This does not include past season inventory or items on sale.

6. Waiver and Release

The Customer releases and discharges the Company, its agents, employees, and affiliates from any and all claims, liabilities, or damages arising out of or related to the use of the rental equipment, including but not limited to claims based on negligence.

7. Indemnification

The Customer agrees to indemnify and hold harmless the Company, its agents, employees, and affiliates from any claims, damages, or expenses arising from the Customer’s use of the rental equipment.

8. Equipment Inspection

The Customer acknowledges that they have inspected the equipment prior to use and found it to be in good condition. Any existing damage must be reported to the Company before use. The Customer acknowledges that the equipment will be inspected by the Company upon rental return, and any assessed damage beyond normal wear and tear is the responsibility of the Customer.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Colorado.

10. Acknowledgment and Agreement

By checking this box, the Customer acknowledges that they have read, understood, and agreed to the terms and conditions of this Agreement.
